Entri Jobs (accessible via https://entrijobs.com and/or https://jobs.entri.app/jobs and the Entri mobile application) is a job search, aggregator, and recruitment platform owned and operated by Entri Software Private Limited ("Entri," "We," "Us," or "Our"). The platform serves "Job Seekers" and "Employers".
Binding Acceptance (Clickwrap): You become legally bound by these Terms of Service by taking a clear affirmative action, including registering an account, submitting a job application, posting a job listing, or effecting a payment on the platform. If you do not agree to these Terms, you must not create an account or utilize the services.
Passive Browsing: If you are merely browsing the platform without registering or interacting with the services, your access is governed by our Website Usage Notice.
Accurate Information: Users must provide true, accurate, current, and complete information. Job Seekers warrant the accuracy of their educational and professional histories. Employers must provide verifiable corporate details (e.g., GSTIN, CIN).
Account Security: Users are strictly responsible for maintaining the confidentiality of login credentials. Entri shall not be liable for any loss arising from unauthorized account access.
Suspension and Termination: Entri reserves the right to immediately terminate or suspend any account without notice for: (a) fraud or material misrepresentation; (b) a binding legal or regulatory order; (c) a violation of Section 4 (Prohibited Content) or Section 6 (Prohibited Conduct); or (d) failure to pay undisputed invoices after demand.
For all other operational breaches by paid Employers, Entri shall provide a seven (7) day written notice and cure period prior to suspension or termination.
The Success Fee Model: Employers onboarded under a "Success Fee" model agree to pay Entri a pre-agreed fee upon the successful hiring or onboarding of a candidate sourced through Entri Jobs.
Attribution Window: A candidate shall be deemed sourced through Entri Jobs for twelve (12) months from the date the Employer accessed or received the candidate's profile or resume via the platform, whichever is earlier.
Reporting Obligation: The Employer is legally obligated to notify Entri in writing within seven (7) days of extending an offer to, or successfully hiring, an Entri candidate.
Anti-Circumvention (Liquidated Damages): Employers shall not attempt to bypass Entri's fee structure by communicating with candidates outside the platform to hide a hiring event. In the event of proven circumvention, Entri shall be entitled to recover the full applicable Success Fee as liquidated damages, being a genuine pre-estimate of the loss sustained by Entri, alongside account termination.
Invoicing, Interest, and Taxes: All fees are exclusive of applicable taxes. GST will be levied as per statutory rates. Employers are responsible for remitting TDS under Section 194J/194R of the Income Tax Act, 1961, where applicable, and providing corresponding TDS certificates. Late payments shall attract simple interest calculated daily at 1.5% per month, exclusive of applicable GST.
Employers are strictly prohibited from posting jobs that involve any of the following:
Multi-Level Marketing (MLM), pyramid schemes, or franchise opportunities.
Roles requiring the Job Seeker to pay an upfront fee, deposit, or "training fee."
Misleading, fake, or "bait-and-switch" job descriptions, or duplicate postings to manipulate search rankings.
Statutory Labour Violations: Any posting that violates the Minimum Wages Act, 1948; the Child Labour (Prohibition and Regulation) Act, 1986; the Bonded Labour System (Abolition) Act, 1976; or roles requiring overseas deployment that fail to comply with the Emigration Act, 1983 and any other applicable laws and regulations.
Anti-Discrimination: Discriminatory language or hiring criteria based on race, caste, religion, gender, age, disability (Rights of Persons with Disabilities Act, 2016), marital status, pregnancy, HIV/AIDS status (HIV/AIDS Act, 2017), or sexual orientation.
Authenticity: Job Seekers warrant that all resumes and portfolios submitted are genuine. Falsifying degrees or identity will result in a permanent ban.
Professional Conduct: Job Seekers who repeatedly fail to attend scheduled interviews without prior notice ("ghosting") may have their profile restricted.
Anti-Retaliation & Misuse: Entri expressly prohibits Employers from retaliating against Job Seekers for exercising statutory rights. Conversely, Job Seekers are strictly prohibited from utilizing Employer contact details for any purpose other than the specific job application.
Users shall not:
Use automated scripts, bots, or scraping tools to mass-download resumes or user data.
Engage in credential stuffing, unauthorized API access, or account sharing.
Reverse-engineer, decompile, or attempt to extract the source code of the platform.
Upload viruses, malware, or malicious code.
Resell, lease, or sub-license access to the Entri Jobs database.
Candidate Consent: By applying for a job or making their profile public, Job Seekers authorize Entri to transmit their personal data to prospective Employers.
Joint-Fiduciary Responsibility: Upon the transfer, download, or transmission of candidate data to an Employer, both Entri and the Employer bear independent statutory obligations as Data Fiduciaries under the DPDP Act, 2023, for their respective processing activities.
Employer Indemnity: The Employer warrants strict compliance with the DPDP Act, 2023, for its post-receipt processing, storage, and communication practices. The Employer shall defend and indemnify Entri against any regulatory penalties or third-party claims arising from post-handoff, Employer-caused data breaches or statutory violations. This allocation does not limit either party's statutory liability to the data principal or the Data Protection Board.
Principal Entity Compliance: Entri maintains Principal Entity registration on approved DLT platforms and dispatches commercial communications strictly through Registered Telemarketers using approved Content Templates, in compliance with TRAI's TCCCPR, 2018.
Consent and Opt-Out: Users consent to receive platform-generated transactional communications (delivered 24/7). Users explicitly opting into promotional or recruitment outreach communications will receive them only during the standard operational window of 9:00 AM to 9:00 PM (IST). Users reserve the right to opt-out of promotional communications at any time.
Entri's IP: All platform designs, algorithms, and software are the exclusive property of Entri.
User UGC: You retain ownership of your resumes, company logos, and job descriptions. You grant Entri a worldwide, royalty-free, non-exclusive, sub-licensable (solely to Entri's service providers, affiliates, and successors-in-interest) license to use and display this content to operate the platform. Licenses granted in respect of content already transmitted to Employers shall survive termination to the extent necessary for the receiving Employer's continued lawful use.
Intermediary Status: Entri acts strictly as an intermediary technology platform under Section 79 of the Information Technology Act, 2000. We do not guarantee employment, nor do we comprehensively vet Employers or Job Seekers.
AI Job Matching Disclaimer: Entri Jobs utilizes artificial intelligence (AI) algorithms to suggest relevant job opportunities based on a Job Seeker's stated qualifications. This matching process is probabilistic and may contain errors. Entri makes no warranties regarding the accuracy or suitability of any AI-generated match. It is the sole duty of the Job Seeker to independently verify job requirements before applying.
AI Company Reviews & Defamation Shield: The platform may utilize AI to aggregate and summarize Employer reviews, reputation data, or public sentiment sourced from publicly available third-party internet content. These summaries are generated automatically, are provided strictly "as is" for informational purposes, and do not represent the opinions, factual assertions, or endorsements of Entri. Entri expressly disclaims any liability for defamation, misrepresentation, or economic loss arising from these AI-generated summaries of third-party content.
Takedown Procedure: In compliance with the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, users may report unlawful content to our Grievance Officer, Fasmina Hisam, at privacy@entri.me. Entri maintains a 36-hour takedown workflow upon acquiring actual knowledge via a valid court order or appropriate government notification.
Liability Cap: Entri's aggregate liability for any claim arising out of these Terms shall be capped at the greater of (a) INR 10,000 or (b) the fees actually paid by the user to Entri in the twelve (12) months preceding the claim.
Statutory Carve-Outs: The aforementioned liability cap shall not apply in cases of: (i) Entri's wilful misconduct, fraud, or gross negligence; (ii) Entri's infringement of third-party intellectual property; (iii) breaches of confidentiality; (iv) death or personal injury; or (v) liabilities that cannot be limited under applicable law, including the DPDP Act 2023, the IT Act 2000, and the Consumer Protection Act 2019.
Mutual Indemnification: You agree to indemnify Entri against claims arising from your violation of these Terms or applicable employment laws. Entri reciprocally agrees to indemnify you against third-party claims alleging that the Entri platform infringes upon third-party intellectual property rights.
Subject to any non-derogable consumer protection laws favoring Job Seekers, these Terms shall be governed by the laws of India.
B2B Dispute Resolution: For commercial disputes with Employers, the parties shall first attempt resolution through mediation for thirty (30) days. Unresolved disputes shall be referred to mandatory binding arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator. The seat of arbitration shall be Ernakulam, Kerala, and the language shall be English.
Age of Registration: Platform usage is strictly limited to individuals aged 18 years or older.
Electronic Contract Validity: Acceptance of these Terms constitutes a valid electronic contract under Section 10A of the IT Act, 2000.
Force Majeure: Entri shall not be liable for delays or failures resulting from events beyond its reasonable control, including cyber-events, telecommunication outages, Acts of God, or regulatory shutdowns. Entri will provide prompt notice of any such event. If a Force Majeure event continues for more than thirty (30) days, either party may terminate this Agreement upon written notice.
Severability & Waiver: If any provision is deemed invalid, the remainder of the Terms shall survive. Failure to enforce any right does not constitute a waiver.
Assignment: Entri may assign this contract in the event of a merger or acquisition. Users may not assign their rights without written consent.
Entire Agreement: These Terms, alongside the Privacy Policy, constitute the entire agreement between the user and Entri.
Notices: Legal notices to Entri must be served physically to our registered corporate office in Ernakulam, Kerala, and electronically to legal@entri.me under Section 13 of the IT Act, 2000.
